Website/Service: speedbikego.com (hereinafter “Site”, “Service”).

1. General provisions

1.1. This Policy describes what data is processed and how when you use the Site and Service, including registration, listing placement, booking/ordering services, communications and performance of contractual obligations (including deposits).

1.2. The Policy applies to all users of the Site, including unregistered visitors, registered users, equipment owners/sellers (where applicable) and other counterparties.

1.3. This Policy is not legal advice but is intended to meet transparency requirements. For applicable law we recommend consulting qualified professionals.

2. Definitions

2.1. “Personal data” — any information relating to an identified or identifiable natural person.

2.2. “Processing of personal data” — any operation on data (collection, recording, storage, use, transfer, deletion, etc.).

2.3. “Controller” — the entity that determines the purposes and means of processing (here: CÔNG TY TNHH PHOENIX ORIENTAL VIETNAM).

3. What data we collect

3.1. Data you provide directly:

  • On registration/login: login/identifier, e-mail (if requested), password (stored as hash), other profile data (if provided by forms);
  • On booking/order: dates, selected equipment/service, comments;
  • For deposit/identity verification (if required by rental terms): photo/scan of passport and/or document details (as specified in the form) and deposit details. Such data is processed only to the extent and for the purposes stated in the form, stored with appropriate security measures and not disclosed to third parties except as required by law or with your consent;
  • When contacting support: name, contact details, content of the inquiry;
  • When publishing content: reviews, photos, videos, descriptions (if the feature is enabled).

3.2. Data collected automatically:

  • Technical data: IP address, browser/device data, cookies and similar technologies, session identifiers, date/time of access;
  • Data on actions on the Site (security logs, fraud prevention, etc.).

3.3. Data of third parties that you upload or provide (e.g. when booking on behalf of another person) — you confirm that you have lawful grounds and consents for such transfer.

4. Purposes of processing

We process personal data only for specific purposes, including:

4.1. Account registration and provision of Service functionality (authorisation, favourites, booking access).

4.2. Performance of contractual obligations: organising booking/rental, processing statuses, invoicing/payments, refunds, order-related communications.

4.3. Deposit management and verification of rental conditions (including processing of passport photo/copy if required by a specific listing/lessor).

4.4. Security: preventing abuse, protecting accounts, investigating incidents, maintaining logs.

4.5. Feedback and support.

4.6. Analytics and improvement of the Service (if analytics tools are enabled): measuring traffic and interface effectiveness.

4.7. Marketing communications (newsletters/promotions) — only with separate consent and with the possibility to opt out.

5. Legal bases for processing

5.1. We process data where one or more of the following apply: necessity for conclusion/performance of a contract with the user (e.g. booking/rental/sale via the Service); compliance with legal obligations (e.g. responding to data subject requests, security and reporting); consent (e.g. marketing; non-essential cookies/analytics; publication of reviews/photos for marketing).

5.2. Where processing is based on consent, you may withdraw it at any time (see “Your rights”).

6. Cookies and similar technologies

6.1. We use cookies: strictly necessary (e.g. session and authentication); functional (language/interface settings where used); analytical (if web analytics is enabled); marketing (if ad pixels/retargeting are used).

6.2. The Site may display a notice about the use of cookies. You can manage cookies through your browser settings; disabling cookies may result in some Service features not working correctly.

6.3. You can manage cookies in your browser settings; some Service features may not work correctly if cookies are disabled.

6.4. Where web analytics tools are used, such services may use cookies and collect device and interaction data. Categories of providers are set out in Appendix A.

7. Disclosure to third parties

7.1. We may disclose data to: IT providers (hosting, cloud, support) for operation of the Service; payment providers for processing payments (provider indicated on the payment page); equipment owners/partners where the Service acts as a platform and minimal data (e.g. name/contact/dates) is needed for the booking; public authorities where required by law.

7.2. We do not sell personal data to third parties.

7.3. Telegram/messengers. If you follow links and communicate with lessors/partners on Telegram, data processing there is governed by Telegram’s rules and your agreement with Telegram. The Controller is not responsible for processing by third parties in messengers.

8. International transfers and third countries

8.1. Where infrastructure/contractors are outside the Controller’s country of registration, we ensure compliance with requirements for international transfers, including assessment of the destination country and appropriate safeguards under applicable law (including Vietnam and EU law where GDPR applies).

8.2. Information on the location of data and on providers is provided to the extent required by applicable law.

9. Data retention

9.1. We retain personal data no longer than necessary for the processing purposes set out in this Policy or as required by applicable law. Once the purpose is achieved, data is deleted or anonymised. Anonymised or aggregated data that does not identify individuals may be retained without time limit.

9.2. Once the purpose is achieved, data is deleted/destroyed or anonymised unless the law requires otherwise.

10. Security measures

10.1. We apply reasonable organisational and technical security measures appropriate to the nature of the data processed and the risks involved.

10.2. Access to document photos/copies and deposit data is on a need-to-know basis.

11. Your rights

11.1. You have the right to request information on what personal data we process and to request rectification, restriction or erasure where provided by law. The scope and procedure for exercising these rights are determined by applicable law.

11.2. You may withdraw consent where processing is based on consent.

12.2. No separate DPO is appointed for GDPR; inquiries are handled at the contacts in section 12.1.

13. Policy updates

13.1. We may update this Policy. The current version is published on the Site with effective date and version number.

13.2. Material changes (categories of data, purposes, providers, international transfers) will be accompanied by prominent notice on the Site/in the account. Continued use of the Service after publication of changes constitutes acceptance of the updated Policy to the extent permitted by applicable law.

Nature of the document. This Policy is for information purposes and does not create contractual obligations beyond those required by applicable law.

Severability. If any provision of this Policy is held invalid, the remaining provisions remain in effect.

Appendix A. Categories of third-party services and providers

  • Hosting and infrastructure: for hosting and operation of the Site.
  • Payment services: for processing payments (as indicated on the payment page).
  • Web analytics: when used — tools for analysing traffic (as described in Site settings where available).
  • Newsletters and CRM: when used — in accordance with the consent form for communications.
  • Maps and geodata: when used — as indicated in the relevant section of the Site.
  • Messengers: Telegram and others (for links and contact with lessors/partners). Data processing in messengers is governed by their respective policies.

1. General nature of information

Content on speedbikego.com is for information only. Although we strive to keep it up to date, we do not guarantee completeness or accuracy of descriptions, prices, availability or other information in listings/service cards. The Controller is not liable for losses arising from reliance on such information to the extent permitted by applicable law.

2. Platform and third-party listings

Where the Site acts as a platform, some listings, rental/sale terms and requirements for deposit and documents (including passport photo) may be set by individual equipment owners/partners. You must read the terms of each listing before booking and providing data. The Controller is not liable for the actions of equipment owners and partners, the content of their listings or damage arising from rental/transactions, to the extent permitted by law.

3. Payments and financial operations

Payments may be processed by third-party payment providers. We do not receive or store full card details unless expressly stated on the payment page. The specific provider and processing terms are set out in the documentation and on the payment page. The Controller is not liable for the actions of payment systems and banks.

4. Safety, risks of using equipment and user responsibility

Rental and use of two-wheeled transport involves increased risk. You agree to: comply with local traffic rules and driving licence requirements; use protective equipment; assess the condition of equipment on collection; not ride under the influence of alcohol or drugs.

We are not liable for harm to life/health/property of the user or third parties resulting from the user’s breach of operating rules, traffic rules or rental terms, to the extent permitted by law. Responsibility for compliance and care of equipment lies with the user and/or equipment owner under the rental agreement and applicable law.

5. Service availability and technical failures

We do not guarantee uninterrupted operation of the Site. Interruptions, errors and delays may occur due to maintenance, updates, third-party actions, connectivity failures, etc. The Controller is not liable for indirect losses or lost profit due to Service unavailability to the extent permitted by applicable law.

6. Links to third-party resources

The Site may contain links to third-party sites and services (e.g. Telegram). We do not control their content or data practices and are not responsible for their operation.

7. User content

Where reviews/photos/descriptions are posted by users, we do not guarantee their accuracy. Content reflects the authors’ views. If you become aware of rights violations (e.g. publication of others’ personal data), please report to speedbikego@gmail.com.

8. Age restriction

The Service is intended for persons aged 18 or over (or the age set by applicable law). Use by minors is only permitted with the involvement of a legal representative and, where required, their consent.
